Can Foreigners Own a Condominium in Thailand? Here’s What You Should Know!

Many expats and investors are surprised to learn that foreigners can legally own a condominium in Thailand in their own name! 

Under the Condominium Act B.E. 2522 (1979), foreigners are allowed to own up to 49% of the total sellable area of a condominium project.
That means as long as the foreign ownership quota is not full, you can buy, hold, and register the unit under your own name.


However, there are important legal conditions to follow:

  • Foreign Currency Requirement (FET Form):
    Your purchase funds must be transferred into Thailand in foreign currency and recorded as such by your bank. This FET document is required when registering ownership at the Land Office.

  • Ownership of Land:
    Foreigners cannot own land directly, but you can own a condo built on the land, as long as the quota allows.

  • Due Diligence & Contract Review:
    Always check the project license, title deed (Chanote), and developer’s reputation before signing.

  • Inheritance Planning:
    If you plan to leave your condo to your heirs, make sure your Thai Will includes the property to avoid future legal issues.
